OVERVIEW

Welcome to Sunlit Aesthetic. Sunlit Skincare LLC, doing business as Sunlit Aesthetic, operates this store and website. The terms “we,” “us,” and “our” refer to Sunlit Aesthetic. We provide the website and its related information, content, features, tools, products, booking links, and services to give customers a curated skincare and aesthetic experience (the “Services”). Sunlit Aesthetic is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights and address areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy, available through the Privacy Policy link in the website or checkout footer. If you do not agree to these Terms or the Privacy Policy, do not use or access the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us permission to allow any minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing products or services, you may be asked to provide information such as your email address and billing, payment, and shipping information. You represent and warrant that the information you provide is correct, current, and complete and that you have the right to provide it.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS AND SKINCARE INFORMATION

We make reasonable efforts to describe and display products accurately. Product color or appearance may vary because of your device, screen, settings, or changes made by the manufacturer. We do not guarantee that a product’s appearance will be identical to the way it appears on your screen.

Product descriptions, prices, packaging, formulas, ingredients, directions, and availability may change. Manufacturers may update a product without notice. Review the label, ingredient list, directions, and warnings supplied with the product before use. The label supplied with the product controls if it differs from website content.

Sunlit provides general skincare education, aesthetic recommendations, and product guidance. This information does not replace medical advice, diagnosis, or treatment from a qualified healthcare professional. Product suitability, tolerance, and results vary by person. A skin guide, consultation, recommendation, testimonial, service description, or product description does not guarantee a particular outcome. Consult a qualified healthcare professional when you have questions about a medical condition, medication, allergy, pregnancy, or serious reaction.

We may discontinue a product or limit the quantity offered to a person, geographic region, or jurisdiction, subject to applicable law.

SECTION 3 — ORDERS

When you place an order, you make an offer to purchase. Sunlit Aesthetic may accept or decline an order for a reasonable business reason, including product availability, an incorrect price or description, a payment issue, a purchase limit, or suspected fraud. Your order is accepted when we confirm acceptance after receiving and processing payment. An automated order-receipt message does not by itself guarantee acceptance or shipment.

Review your order carefully before submitting it. We may be unable to change or cancel an order after fulfillment begins. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided with the order. If we cancel an amount you have already paid, we will refund that amount to the original payment method.

Purchases are subject to our Return Policy, available through the Return Policy link in the website or checkout footer. Review that policy before purchasing, especially because opened or used skincare products may not be eligible for return.

You represent that purchases are for your own personal or household use and not for unauthorized commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed and will appear in your order confirmation. Unless stated otherwise, posted prices do not include taxes or shipping charges. Applicable taxes, shipping charges, discounts, and the final order total are displayed during checkout.

Prices in the online store may differ from prices offered at the studio or by third parties. Promotions may have separate dates, requirements, and exclusions. If a promotion’s terms conflict with these Terms, the promotion’s terms govern that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information. You agree to update information such as your email address and payment details so we can complete transactions and contact you when needed.

You represent that the payment information you provide is accurate, that you are authorized to use the payment method, and that you will pay the charges shown at checkout, including shipping and applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

Shipping is governed by our Shipping Policy, available through the Shipping Policy link in the website or checkout footer and incorporated into these Terms.

At this time, we ship physical products to eligible street addresses in California and do not ship to PO boxes. Orders are usually prepared for shipment within 2–4 business days. Standard delivery usually takes an additional 2–8 business days after shipment. These timeframes are estimates and are not guaranteed.

Sunlit may arrange for products to ship from fulfillment locations used by the applicable product brands. Products from different brands or locations may arrive in separate packages and on different days. Sunlit remains your contact for order support, returns, damaged products, and incorrect products.

We are not responsible for delays caused by carriers, severe weather, address problems, or other events outside our reasonable control. If we cannot ship within the promised time, we will provide notice and the options required by applicable law. Subject to applicable law, title and risk of loss pass when the product is transferred to the carrier. This does not limit any right or remedy that cannot legally be limited.

SECTION 6 — INTELLECTUAL PROPERTY

The Services, including trademarks, branding, original text, displays, photographs, graphics, product reviews, video, audio, and the selection and arrangement of this content, are owned by Sunlit Aesthetic, its affiliates, or its licensors and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, noncommercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without prior written permission, except as allowed by law or expressly stated in these Terms.

Nothing in these Terms grants a license or other right under a patent, trademark, copyright, or other intellectual-property right belonging to Sunlit Aesthetic, Shopify, a product manufacturer, or another third party. Unauthorized use may violate federal or state law. All rights not expressly granted are reserved.

Sunlit Aesthetic’s name, logo, product and service names, designs, and slogans are trademarks of Sunlit Aesthetic or its licensors. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, product and service names, designs, and slogans belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

The Services may provide access to tools offered by third parties that we do not monitor or control.

Access to these tools is provided “as is” and “as available” without warranties, representations, conditions, or endorsement, to the fullest extent permitted by law. We are not liable for issues arising solely from your use of an optional third-party tool.

Your use of an optional tool is at your discretion. Review and approve the third party’s terms before using it.

We may offer new features, tools, or resources in the future. Those additions will be part of the Services and subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain content, functionality, or links provided or operated by third parties, including Shopify, payment providers, Vagaro, carriers, social platforms, and product manufacturers. We are not responsible for evaluating every third-party website or for the accuracy of content you choose to access there.

Review a third party’s policies and practices before using its services or completing a transaction. Questions about an order placed with Sunlit should be directed to Sunlit. Questions about a separate purchase made directly from a third party should be directed to that third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Sunlit Aesthetic is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Sunlit Aesthetic. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sunlit Aesthetic, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sunlit Aesthetic.

SECTION 10 — PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy, available through the Privacy Policy link in the website or checkout footer. Certain personal information may also be subject to Shopify’s Consumer Privacy Policy at https://www.shopify.com/legal/privacy/consumers. By using the Services, you acknowledge that you have had an opportunity to review these privacy policies.

Because Shopify hosts the commerce portions of the Services, Shopify collects and processes information about access to and use of those Services to provide and improve them. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside the place where you live, as described in the applicable privacy policies.

SECTION 11 — FEEDBACK

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for purposes including operating, evaluating, improving, and promoting the Services.

You represent that you own or have the necessary rights to your Feedback, that you have disclosed any compensation or incentive connected with it, and that the Feedback complies with these Terms. We have no obligation to keep Feedback confidential, pay compensation for it, or respond to it.

We may monitor, edit, or remove Feedback that we reasonably determine is unlawful, infringing, threatening, defamatory, obscene, or otherwise violates these Terms. Feedback must not violate another person’s copyright, trademark, privacy, publicity, or other rights; contain unlawful, abusive, or obscene material; contain malicious code; or misrepresent its source. You are responsible for the Feedback you submit and its accuracy.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Information in the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, prices, promotions, offers, shipping charges, transit times, or availability. Subject to applicable law, we may correct an error, update information, or cancel an affected order. If we cancel a paid order, we will refund the canceled amount to the original payment method.

SECTION 13 — PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not use the Services directly or indirectly:

(a) for an unlawful or malicious purpose;
(b) to violate an international, federal, state, provincial, or local law or regulation;
(c) to infringe our intellectual-property rights or the rights of another person;
(d) to harass, abuse, threaten, defame, intimidate, or harm another person;
(e) to transmit false or misleading information;
(f) to send or reuse material that does not comply with these Terms;
(g) to send unsolicited advertising, junk mail, chain letters, spam, or similar solicitations;
(h) to impersonate another person or entity; or
(i) to engage in conduct that restricts another person’s use of the Services or that may harm Sunlit Aesthetic, Shopify, or users of the Services.

You also may not:

(a) introduce malicious code;
(b) reproduce, duplicate, copy, extract, sell, resell, or exploit a portion of the Services without permission;
(c) improperly collect or track personal information about others;
(d) spam, phish, pharm, or pretext the Services;
(e) use robots, spiders, scraping or extraction tools, automated devices, artificial-intelligence tools, or manual processes to access the Services in violation of these Terms; or
(f) interfere with, bypass, or circumvent security, authorization, robot-exclusion, or access-control measures.

We may suspend, disable, or terminate access if we reasonably determine that you violated these Terms.

SECTION 14 — AGENTS

14.1 This section (“Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity and that can act on a person’s behalf or device without direct supervision.

14.2 An Agent may not access, use, or interact with the Services unless it identifies itself and follows Section 14.4. An Agent may not access, use, or interact with the Services after we have requested that it stop.

14.3 We may use technical measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4 An Agent must: (i) identify each HTTP or HTTPS request as an Agent request and disclose the Agent’s name in the user-agent string using “Agent/[agent name]”; (ii) not conceal that access or interaction comes from an Agent, including by imitating human behavior or bypassing a CAPTCHA or similar measure; (iii) answer truthfully when asked whether an interaction comes from a person or computer; and (iv) not bypass a measure intended to block, limit, modify, or control Agent access or interaction.

SECTION 15 — TERMINATION

We may suspend or terminate your access to the Services when we reasonably determine that you violated these Terms, created a security or fraud risk, or used the Services unlawfully. You remain responsible for amounts properly due before termination.

Sections that by their nature should continue after termination will remain in effect, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy Policy.

SECTION 16 — DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes. We do not guarantee that all general information will always be complete, current, or suitable for your individual circumstances. Reliance on general skincare or aesthetic information is at your discretion, subject to rights that cannot legally be excluded.

EXCEPT AS EXPRESSLY STATED BY SUNLIT AESTHETIC AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions limit or prohibit the exclusion of implied warranties. These exclusions apply only to the extent allowed by law. Nothing in these Terms excludes a warranty, right, or remedy that applicable consumer-protection law does not allow us to exclude.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SUNLIT AESTHETIC, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM USE OF THE SERVICES OR PRODUCTS PROCURED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

WHERE LIABILITY CANNOT BE EXCLUDED BUT MAY BE LIMITED, SUNLIT AESTHETIC’S TOTAL LIABILITY RELATING TO A PARTICULAR PRODUCT ORDER WILL NOT EXCEED THE AMOUNT PAID TO SUNLIT AESTHETIC FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

This section does not limit liability where doing so would be unlawful, including liability for fraud, willful misconduct, or other liability that applicable law does not allow us to exclude or limit.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Sunlit Aesthetic, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, and claims, including reasonable attorneys’ fees, arising from: (1) your material breach of these Terms or a policy incorporated into them; (2) your violation of applicable law or a third party’s rights; or (3) your unlawful or unauthorized use of the Services.

We will notify you of an indemnifiable claim. Failure to notify you promptly does not relieve you of your obligations unless the delay materially prejudices you. We may control the defense and settlement of the claim at our expense or, where permitted by law, at your expense. We will not agree to a settlement that imposes a nonmonetary obligation on you without your reasonable consent. You agree to cooperate in the defense by providing relevant information and documents.

SECTION 19 — SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will continue in effect.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision under these Terms is not a waiver of that right or provision.

These Terms and the policies or operating rules posted through the Services form the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning the Services.

An ambiguity in these Terms will not automatically be interpreted against the party that drafted them.

SECTION 21 — ASSIGNMENT

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent. An attempted assignment made without required consent is void. We may transfer or assign these Terms and our rights and obligations as permitted by applicable law.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreement through which we provide Services are governed by the laws of the State of California, without regard to conflict-of-law principles. You and Sunlit Aesthetic consent to the jurisdiction of courts with proper authority in San Francisco County, California, except where applicable law permits or requires a different venue.

Headings are included for convenience and do not limit or otherwise affect these Terms.

SECTION 24 — CHANGES TO THESE TERMS

You may review the current version of these Terms on this page at any time.

We may update these Terms to reflect changes to the Services, operations, or legal obligations. We will post the revised version with a new “Last updated” date and provide any notice required by applicable law. The Terms in effect when you place an order will govern that order.
